Terms of Service

By accessing or using WKND ("the Platform"), operated by WKND Company ("WKND," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.

These Terms apply to all users, including travelers, ambassadors, travel agents, promoters, vendors, venue operators, and enterprise clients.

WKND is a marketplace platform. We connect travelers with events, venues, flights, hotels, and experiences. We are not an event organizer, travel agency, hotel operator, airline, or venue owner. We facilitate connections between users and service providers. All transactions on the platform carry inherent risk, and users engage at their own discretion.

By creating an account, you represent and warrant that you meet all eligibility requirements. We may request proof of identity or age at any time.

Account Responsibility

You are responsible for maintaining the security of your login credentials and for all activity under your account. Notify us immediately at support@wkndtour.com if you suspect unauthorized access.

Account Accuracy

You must keep your account information accurate and up to date. Inaccurate information may result in failed transactions, withheld payouts, or account suspension.

One Account Per Person

Each individual may maintain only one account. Creating multiple accounts (for example, to abuse referral bonuses or circumvent a suspension) is prohibited and grounds for immediate termination.

Account Transfers

Accounts are non-transferable. You may not sell, lend, or share your account credentials with another person.

Account Deletion

You may delete your account at any time through your settings or by contacting support. Upon deletion, your data will be handled according to our Privacy Policy. Outstanding financial obligations survive account deletion.

WKND Is a Platform, Not a Provider

WKND provides the technology and marketplace that enables users to discover, book, and pay for events, travel, lodging, and experiences offered by third-party providers. We do not own, operate, manage, or control any of the events, venues, flights, hotels, or services listed on our platform.

No Guarantees

We do not guarantee the quality, safety, legality, or accuracy of any listing, event, service, or user-generated content on the platform. Listings are provided by third parties and may contain errors or omissions.

Your Due Diligence

You are responsible for evaluating listings, reading cancellation policies, confirming details with providers, and making informed decisions before booking.

Third-Party Content

Venue information, photos, and descriptions may be sourced from third-party APIs (including Yelp, Eventbrite, and others) and are used under their respective API terms. We do not guarantee the accuracy or currency of third-party content.

Travel Advisory

Travel involves inherent risks. We recommend purchasing travel insurance for all bookings. WKND does not provide travel insurance.

Payment Processing

All payments are processed securely through Stripe. By making a purchase, you authorize WKND and Stripe to charge your payment method for the total amount due (including applicable fees and taxes). Your payment details are never stored on WKND servers.

Service Fees

Service fees are applied to bookings and vary by user tier. Standard traveler fee is 8% (reduced to 5% for WKND+ subscribers). Fees are displayed before you confirm any booking.

Escrow and Release

Payments for vendor services and certain bookings are held in escrow for up to 14 days. Funds are released to the service provider after the event or service is completed, unless a dispute is filed.

Payment Plans and Installments

Where available, you may pay for bookings in installments. By enrolling in a payment plan, you authorize scheduled charges to your payment method. Missed installment payments may result in booking cancellation and forfeiture of amounts already paid, after a 7-day grace period.

Currency

All prices are displayed in USD unless otherwise indicated. International transactions may incur currency conversion fees from your bank.

Trip Bundles

Bundle pricing reflects combined savings. Individual bundle components may have different refund policies. Changes to a bundle after purchase may incur additional fees or result in loss of bundle pricing.

Chargebacks

If you file a chargeback with your bank instead of using our dispute resolution process, we reserve the right to suspend your account pending investigation. Fraudulent chargebacks may result in permanent account termination and collections action.

General Refund Guidelines

How to Request a Refund

All refund requests must be submitted through the platform (not directly to the vendor). Go to your booking history, select the booking, and submit a refund request with a reason.

How It Works

WKND Ambassadors earn commissions when people they refer make qualifying bookings on the platform. Commissions are a percentage of the booking value, earned on real completed transactions.

Commission Tiers

Commission rates are based on your ambassador tier:

Tier placement is based on booking volume and activity. WKND may adjust tier thresholds and commission rates with 30 days notice.

Multi-Generation Referrals

Ambassadors may earn smaller commissions on bookings generated by people their referrals bring to the platform (second and third generation). This is NOT a pyramid scheme or multi-level marketing structure. All commissions are funded by real transaction revenue from actual bookings, not by recruitment fees. No one pays to become an ambassador. No one earns from recruiting alone.

30-Day Invite Lock

When a new user signs up through your referral link, that referral relationship is locked for 30 days. During this period, qualifying bookings by that user generate commissions for you. After 30 days, the user may be re-attributed if they arrive through a different ambassador link.

Payout Terms

Independent Contractor

Ambassadors are independent contractors, not employees of WKND. See the full Ambassador Agreement at /info/ambassador-agreement.

Prohibited Practices

Violations result in immediate commission forfeiture and potential account termination.

WKND Points

WKND Points are promotional credits awarded for platform activity (bookings, referrals, reviews, etc.). Points can be redeemed for discounts on future bookings.

Key Terms

Program Modifications

WKND reserves the right to modify, suspend, or terminate the points program at any time with 30 days notice. In the event of program termination, we will provide a reasonable window to redeem outstanding points.

Abuse

Attempting to manipulate or exploit the points system (through fake accounts, manufactured activity, or other means) will result in forfeiture of all points and potential account termination.

Your Content, Your Ownership

You retain full ownership of content you post on WKND (reviews, photos, social posts, stories, threads, etc.).

License Grant

By posting content on WKND, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute, and modify your content in connection with operating and promoting the platform. This license ends when you delete your content, except where your content has been shared by others or incorporated into platform features.

Moderation

We reserve the right to review, moderate, and remove content that violates these Terms or our community guidelines, without prior notice. Repeated violations may result in account suspension.

Reviews

Reviews must reflect honest, firsthand experiences. Fake reviews, paid reviews (without disclosure), and retaliatory reviews are prohibited.

AI Articles and Summaries

WKND uses artificial intelligence (powered by Anthropic Claude and other AI services) to generate articles, venue summaries, event descriptions, and personalized recommendations.

Accuracy Disclaimer

AI-generated content may contain inaccuracies, outdated information, or errors. AI content is provided for informational and entertainment purposes only and does not constitute professional travel advice, legal advice, or any other form of professional guidance.

Your Responsibility

Always verify important details (event dates, prices, venue hours, travel requirements) directly with the provider before making decisions based on AI-generated content.

Labeling

AI-generated content is labeled as such where practical. We strive for transparency about when content is AI-assisted versus human-authored.

Enterprise SaaS

Enterprise clients use WKND as a platform for managing events, venues, and operations. Enterprise features are provided on a subscription basis.

Data Ownership

Enterprise clients retain ownership of their proprietary business data (event data, customer lists, financial records). WKND retains ownership of platform data, aggregated analytics, and system-generated insights.

Uptime

We strive for high availability but do not guarantee specific uptime percentages for any tier. Free-tier enterprise accounts have no service level agreement. Paid enterprise tiers may include SLA terms in their subscription agreement.

White-Label Content

Enterprise clients may customize their WKND landing pages with their own branding. Content published on enterprise pages must comply with these Terms and applicable law.

Agent Bookings

Verified travel agents may book on behalf of clients through the platform. By doing so, you represent that you have proper authorization from the traveler.

Agent Responsibility

Travel agents are responsible for communicating all booking terms, cancellation policies, and fees to their clients. WKND is not liable for miscommunications between agents and their clients.

Commissions

Agent commissions are governed by the agent's tier and subscription plan. Agent commission rates may differ from ambassador rates.

WKND's Property

The WKND name, logo, platform design, codebase, algorithms, and all associated branding are the property of WKND Company. You may not copy, modify, distribute, or create derivative works from our intellectual property without written permission.

User Content

As stated above, you retain ownership of your content but grant us a license to use it on the platform.

Trademarks

You may not use WKND trademarks in a way that suggests endorsement, affiliation, or sponsorship without written approval. Ambassadors may use approved marketing materials provided through the platform.

Copyright Claims

We respect intellectual property rights. If you believe content on WKND infringes your copyright, see our DMCA Policy at /info/dmca.

Disclaimer of Warranties

WKND is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Liability Cap

To the maximum extent permitted by applicable law, WKND's total liability to you for any claims arising from or related to your use of the platform is limited to the amount you have paid to WKND (not to vendors or service providers) in the 12 months preceding the claim.

Exclusion of Damages

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, personal injury, or property damage, whether based on warranty, contract, tort, or any other legal theory — even if we were advised of the possibility of such damages.

Third-Party Actions

We are not liable for the actions, omissions, or conduct of any user, vendor, promoter, venue, airline, hotel, or other third party.

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless WKND Company, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Informal Resolution First

Before filing a formal claim, you agree to contact us at legal@wkndtour.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

Any dispute that cannot be resolved informally will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in Wayne County, Michigan, USA.

Class Action Waiver

You agree to resolve disputes with WKND on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding. If this waiver is found unenforceable, the entire arbitration provision is void.

Opt-Out

You may opt out of binding arbitration within 30 days of creating your account by sending written notice to legal@wkndtour.com with subject line "Arbitration Opt-Out."

Small Claims

Nothing in these Terms prevents either party from seeking relief in small claims court for disputes within that court's jurisdiction.

Governing Law

These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict of law provisions.

Between Users

For disputes between users (e.g., between a traveler and a vendor), our support team may assist with mediation. Decisions by our support team on platform-related disputes are final.

By You

You may close your account at any time. Outstanding financial obligations (unpaid bookings, installment plans, commission clawbacks) survive termination.

By WKND

We may suspend or terminate your account immediately if you:

Effect of Termination

We may update these Terms from time to time. When we make material changes:

If you disagree with the changes, you may close your account before the effective date. We encourage you to review these Terms periodically.

Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Ambassador Agreement, and Vendor Agreement, constitute the entire agreement between you and WKND.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign your rights or obligations under these Terms. WKND may assign its rights and obligations without restriction.

Force Majeure

WKND is not liable for delays or failure to perform due to circumstances beyond our reasonable control (natural disasters, pandemics, government actions, infrastructure failures, etc.).
